Limited Liability Indemnity

This page sets out the limits of our liability, and what you agree to cover, when you use thaifishermanpants.net or buy from Thai Fisherman Pants, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions.
What we do not limit
Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded. That includes:
- Liability for death or personal injury caused by our negligence.
- Liability for fraud or fraudulent misrepresentation.
- Your rights under the Thai Consumer Protection Act B.E. 2522 (1979) and the Electronic Transactions Act B.E. 2544 (2001).
- Any right you have under the consumer law of your own country. We sell worldwide, and where your local law gives you protection that cannot be signed away, it still applies.
Where those rights apply, they come first and they override anything else on this page.
The limits that do apply
Subject to the section above, and as far as the law allows:
- We are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill.
- We are not liable for loss or damage that was not reasonably foreseeable, or that was caused by misuse of an item, by ignoring the care instructions, or by ordinary wear and tear.
- Where we are liable, our total liability for any claim connected with an order is limited to what you paid for the goods in that order.
- We are not liable for delays or failures caused by events outside our reasonable control, such as customs holds, carrier disruption, strikes, extreme weather or a government restriction on imports.
The website itself
We work to keep this site running properly, but we do not guarantee it will always be available, uninterrupted or free of errors. We may change, suspend or withdraw any part of it without notice, and we are not liable if it is unavailable at some point. Where we link out to other sites, we do not control them and we are not responsible for what is on them.
What you cover
You agree to cover our reasonable losses, costs and claims where they come from your breach of our Terms & Conditions, your misuse of this site, or your use of the site in a way that infringes someone else's rights.
Governing law
This page is governed by the law of Thailand, and the courts of Thailand have jurisdiction over any dispute arising from it. That does not remove any protection you have under the mandatory consumer law of the country you live in, or your right to bring a claim there where your local law allows it.
